L2 Visa Holders are allowed to work in the United States. L-2 visa holders are the spouses of L-1 visa holders, who is allowed to accompany L-1 visa holders during their stay in the USA. L-1 visa holders are those non-immigrants, who work for international companies with offices both in the United States and abroad.
Distinct from the H-4 visa holders (who cannot work in the United States), who are the spouses of H-1B visa holders, L-2 visa holders are given Employment Authorization and are legally allowed to work in the United States. I would like to explain the process of obtaining an EAD (Employment Authorization Document) for an L-2 Visa Holder.
Application For Employment Authorization(I-765)
I-765 form needs to be filled up and submitted to the U.S. Citizenship and Immigration Services (USCIS). The application can be submitted to the USCIS in two ways:
1. E-File:
You may file the L-2 EAD Application online at https://efiling.uscis.dhs.gov/efile/
2. Apply through Regular Mail:
You can download the I-765 form at http://www.uscis.gov/files/form/i-765.pdf and complete the form and submit the form with supporting documents and payment to the USCIS. You may check the address where to mail your documents here.
Supporting documents for L-2 visa EAD
- Filing Fee – Current filing fee for Form I-765 is $380. (As of August 2nd 2013)
- L-1 Approval notice of spouse.
- 2 recent color photographs.
- Copy of I-94 Form.
- Copy of original passport.
- Copy of marriage certificate.
- And of course, do not forget the filled in I-765 form.
Check the Case Status after Filing:
USCIS would send you a receipt after you file for the application. This receipt comprises of a 13-digit receipt number, using which you can check your case status online. The case status can be obtained at:https://egov.uscis.gov/cris/Dashboard.do
The processing time for your case may take few weeks up to three months.
